1. Introduction

The Fruited Life Family & Marriage Counseling, Inc. (“The Fruited Life,” “we,” “us,” or “our”) is a California-based licensed marriage and family therapy practice committed to protecting the privacy and rights of every person who chooses to engage with our services. This SMS Text Message Privacy Policy (“Policy”) describes how we collect, use, disclose, and protect personal information in connection with our SMS text message communications program, which is administered through Mailchimp (an Intuit company).

This Policy is intended to comply with applicable federal and California law, including the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227; the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA), Cal. The Fruited Life Family & Marriage Counseling, Inc. is a private pay counseling practice serving clients in Menifee, California and the surrounding region. Our SMS communications may include information about:

In connection with our SMS program, we may collect the following categories of personal information:

General location: inferred from area code only; we do not collect precise GPS or geolocation data

We do not collect sensitive personal information such as health records, financial account information, social security numbers, or precise geolocation data through our SMS program. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

We use the information collected through our SMS program for the following purposes:

6. Third-Party Service Provider: Mailchimp

Our SMS program is operated using Mailchimp, a marketing automation platform owned by Intuit Inc. Mailchimp processes subscriber data on our behalf as a service provider and is contractually prohibited from using your data for purposes other than providing services to us. Mailchimp’s own privacy practices are governed by its Privacy Policy, available at www.mailchimp.com/legal/privacy.

We are responsible for our own use of your personal information and for ensuring that Mailchimp’s use is consistent with this Policy. If you have questions specifically about how Mailchimp processes data, you may contact Mailchimp directly.

7. How to Stop Receiving Messages (Opt-Out)

You may opt out of our SMS program at any time using any of the following methods:

Reply STOP to any text message you receive from us
Reply HELP to any text message to receive assistance and contact information
Contact us directly at the email address listed in Section 12 of this Policy

Upon receipt of your opt-out request, we will send you a one-time confirmation message and then cease sending you SMS communications. Opting out of SMS messages does not automatically unsubscribe you from our email newsletter or other communications unless you separately request removal from those channels.

Standard keywords recognized by our program include STOP, CANCEL, END, QUIT, and UNSUBSCRIBE (to opt out), and HELP or INFO (to receive assistance).

8. Your California Privacy Rights (CCPA/CPRA)

As a California resident, you have the following rights with respect to your personal information:

Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you, the purposes for which it is used, and the categories of third parties with whom it is shared.
Right to Delete: You may request that we delete personal information we have collected from you, subject to exceptions permitted by law.

9. Data Retention

We retain SMS subscriber information for as long as you remain subscribed to our program or as required by applicable law. Upon receipt of a valid opt-out or deletion request, we will remove your information from our active SMS subscriber list and, where feasible, from our records, subject to any legal retention obligations. Mailchimp may retain certain data in accordance with its own data retention policies.

10. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or data storage is completely secure. We cannot guarantee the absolute security of information transmitted via SMS or stored within third-party systems such as Mailchimp.

We strongly encourage you not to transmit sensitive personal, financial, or protected health information via text message.

11. International Transfers

Our SMS program is administered through Mailchimp, whose servers and infrastructure may be located in the United States or other countries. If you are located outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By opting into our SMS program, you consent to this transfer. We will ensure that any transfer of personal information outside the United States takes place pursuant to appropriate safeguards consistent with applicable law.
