1. Program Description

The Fruited Life Family & Marriage Counseling, Inc. (“The Fruited Life,” “we,” “us,” or “our”) operates an SMS text message program (“Program”) to send subscribers updates, wellness resources, faith-integrated mental health content, announcements, and other information related to our services and community. This Program is administered through Mailchimp (an Intuit company).

These SMS Terms and Conditions (“Terms”) govern your participation in the Program. By opting in, you agree to be bound by these Terms. If you do not agree, do not opt in to the Program.

2. How to Opt In

You may enroll in the Program by one of the following methods:

Completing an online subscription or contact form that includes a clearly labeled SMS opt-in checkbox
Texting a designated keyword to our program number, as displayed on our website or marketing materials
Signing a written opt-in form provided at a session, event, or program registration

By opting in, you represent that you are the account holder or have the account holder’s permission to enroll the mobile number provided, and that you are 18 years of age or older. Consent to receive SMS messages is not a condition of purchasing any goods or services from us.

3. Message Frequency and Content

Message frequency varies and is typically 2 to 4 messages per month, though this may vary based on program activity, announcements, or events. Messages may include:

Wellness tips and faith-integrated mental health resources
Program announcements and upcoming event information
Subscriber newsletter highlights and community updates
Service availability announcements

We do not use this Program to send clinical communications, treatment recommendations, or crisis intervention messages. If you are experiencing a mental health emergency, please call 988 (Suicide & Crisis Lifeline) or 911.

4. Message and Data Rates

Standard message and data rates may apply to messages sent and received through this Program. These charges are assessed by your mobile carrier and are not controlled by The Fruited Life. Please contact your carrier for information about your plan’s messaging rates.

5. How to Opt Out (STOP)

You may opt out of the Program at any time by replying STOP to any text message you receive from us. After we receive your opt-out request, we will send you a one-time confirmation message and then remove you from the Program. You will receive no further SMS messages from this Program unless you re-enroll.

Additional opt-out keywords include: CANCEL, END, QUIT, and UNSUBSCRIBE. All opt-out requests are processed promptly.

Opting out of SMS messages does not unsubscribe you from our email newsletter or other communications unless you separately request removal from those channels.

7. Supported Carriers

This Program is compatible with most major U.S. mobile carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, and MetroPCS. Carrier support may vary. We are not responsible for delayed or undelivered messages due to carrier transmission issues.

8. Delivery of Messages

Delivery of SMS messages is subject to effective transmission from your mobile carrier. The Fruited Life and Mailchimp are not liable for messages that are delayed or undelivered due to any cause beyond our reasonable control, including but not limited to equipment failure, carrier network outages, or service interruptions.

9. Privacy

Your use of this Program is also governed by our SMS Text Message Privacy Policy, which describes how we collect, use, and protect your personal information in connection with this Program. You can review the full Privacy Policy at:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information collected through this Program is used solely to operate and improve the Program as described in our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by applicable law, The Fruited Life shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in this Program, including but not limited to damages for loss of data, loss of goodwill, or service interruptions. Our total liability to you for any claim arising from these Terms shall not exceed the amount, if any, paid by you to participate in the Program.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the Effective Date above and, where appropriate, notify active Program subscribers by SMS. Your continued participation in the Program following notice of a change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may opt out of the Program at any time by replying STOP.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Program shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.
